H\u00e2lbuki T\u00fcrkiye\u2019deki s\u0131\u011f\u0131nmac\u0131 politikalar\u0131 Suriye krizi patlak vermeden \u00f6nce de ulusal ve uluslararas\u0131 d\u00fczeyde \u00f6nemli bir konuydu. Yabanc\u0131lar ve Uluslararas\u0131 Koruma Kanunu (YUKK) AB uyum s\u00fcreci ve Suriye krizinin etkisiyle 2014\u2019te y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir. Bu makale YUKK\u2019un T\u00fcrkiye\u2019deki m\u00fcltecilerin insan haklar\u0131n\u0131 korumaya y\u00f6nelik s\u00fcrd\u00fcr\u00fclebilir \u00e7\u00f6z\u00fcmler sa\u011flayarak, g\u00f6\u00e7 politikas\u0131nda ger\u00e7ek bir de\u011fi\u015fimin k\u00f6\u015fe ta\u015f\u0131 olarak de\u011ferlendirilip de\u011ferlendirilemeyece\u011fini sorgulamaktad\u0131r.<\/span><\/p>\n<p><span style=\"color: #8b0933;\"><strong>Giri\u015f<\/strong><\/span><\/p>\n<p>1990\u2019lardan bu yana T\u00fcrkiye, g\u00f6\u00e7\u00fcn farkl\u0131 bi\u00e7imleriyle kar\u015f\u0131 kar\u015f\u0131ya kalmakta ve d\u0131\u015far\u0131ya g\u00f6\u00e7 veren bir \u00fclkeden d\u0131\u015far\u0131dan g\u00f6\u00e7 alan bir \u00fclkeye d\u00f6n\u00fc\u015fmektedir. Buna ek olarak T\u00fcrkiye art\u0131k Avrupa \u00fclkelerine yerle\u015fmeyi isteyen g\u00f6\u00e7menler i\u00e7in bir ge\u00e7i\u015f \u00fclkesi olarak da g\u00f6r\u00fclmektedir. Ancak yak\u0131n d\u00f6nemde Suriyeli m\u00fcltecilerin T\u00fcrkiye\u2019ye ak\u0131n etmesi, h\u00fck\u00fcmetin bu alanda yeni bir kanun \u00e7\u0131karmas\u0131na ve m\u00fcltecilere ili\u015fkin yeni politikalar belirlemesine neden olmu\u015f ve bu durum T\u00fcrkiye\u2019de g\u00f6\u00e7 olgusunun dinamiklerini de de\u011fi\u015ftirmi\u015ftir.<\/p>\n<p>T\u00fcrkiye\u2019de s\u0131\u011f\u0131nma konusunda bir mevzuat\u0131n bulunmay\u0131\u015f\u0131 ve 1951 Cenevre S\u00f6zle\u015fmesi\u2019ne co\u011frafi s\u0131n\u0131rlama konusunda<a href=\"#_edn1\" name=\"_ednref1\">[1]<\/a> \u00e7ekince koyulmu\u015f olmas\u0131 Avrupa Komisyonu taraf\u0131ndan haz\u0131rlanan T\u00fcrkiye \u0130lerleme Raporlar\u0131\u2019nda y\u0131llarca ele\u015ftirilmi\u015ftir<a href=\"#_edn2\" name=\"_ednref2\">[2]<\/a>. Buna ek olarak, Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM) T\u00fcrkiye\u2019de m\u00fcltecilere y\u00f6nelik koruma sisteminin yetersizli\u011fi ve m\u00fcltecilerin insan haklar\u0131n\u0131n ihlallerine ili\u015fkin olarak baz\u0131 kararlara imza atm\u0131\u015ft\u0131r<a href=\"#_edn3\" name=\"_ednref3\">[3]<\/a>.<\/p>\n<p>T\u00fcrkiye, s\u00f6z konusu ele\u015ftirilere cevaben ve kar\u015f\u0131 kar\u015f\u0131ya oldu\u011fu Suriyeli m\u00fclteci ak\u0131n\u0131 ile ba\u015fa \u00e7\u0131kmak amac\u0131yla, alan\u0131nda uzman isimler ve sivil toplumun \u00f6nde gelen akt\u00f6rleri ile isti\u015farelerde bulunarak Yabanc\u0131lar ve Uluslararas\u0131 Koruma Kanunu\u2019nu (YUKK) haz\u0131rlam\u0131\u015ft\u0131r. 2014 y\u0131l\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe giren YUKK, g\u00f6\u00e7e ili\u015fkin hukuki bo\u015flu\u011fu doldurmada, plans\u0131z ve keyfi d\u00fczenlemeleri sonland\u0131rmada kritik bir \u00f6nem arz etmi\u015ftir. Bu bak\u0131\u015f a\u00e7\u0131s\u0131yla YUKK, T\u00fcrkiye\u2019nin uzun vadeli g\u00f6\u00e7 politikas\u0131nda bir k\u00f6\u015fe ta\u015f\u0131 olarak g\u00f6r\u00fclebilir. Bununla beraber T\u00fcrkiye, Avrupa \u00fclkeleri d\u0131\u015f\u0131ndan olanlara m\u00fclteci stat\u00fcs\u00fc tan\u0131mamas\u0131 anlam\u0131na gelen co\u011frafi k\u0131s\u0131tlamay\u0131 da s\u00fcrd\u00fcrmektedir. Bu durum m\u00fcltecilerin korunmas\u0131 anlam\u0131nda bir mu\u011flakl\u0131k olu\u015fturmaktad\u0131r. Buna ilaveten, keyfi durumlar\u0131n ortaya \u00e7\u0131kmas\u0131n\u0131 \u00f6nlemede ve uygulamalar\u0131n y\u00fcr\u00fcrl\u00fckteki kanunla uyum i\u00e7inde olmas\u0131n\u0131 sa\u011flamada kanunun hayata ge\u00e7irilmesi de en az kanunun \u00e7\u0131kar\u0131lmas\u0131 kadar \u00f6nemlidir.<\/p>\n<p>Bu \u00e7al\u0131\u015fma, YUKK sonras\u0131 T\u00fcrkiye\u2019nin g\u00f6\u00e7 politikas\u0131nda pratikte ger\u00e7ek bir de\u011fi\u015fimin s\u00f6z konusu olup olmad\u0131\u011f\u0131n\u0131 sorgulamay\u0131 ama\u00e7lamaktad\u0131r.<\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div><\/div><\/div><\/div><\/div><div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-3 hundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-padding-top:50px;--awb-padding-right:10%;--awb-padding-bottom:50px;--awb-padding-left:10%;--awb-background-color:#ffffff;\" ><div class=\"fusion-builder-row fusion-row\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-5 fusion_builder_column_5_6 5_6 fusion-five-sixth fusion-column-first\" style=\"--awb-bg-size:cover;width:83.333333333333%;width:calc(83.333333333333% - ( ( 4% ) * 0.83333333333333 ) );margin-right: 4%;\"><div class=\"fusion-column-wrapper fusion-column-has-shadow fusion-flex-column-wrapper-legacy\"><div class=\"fusion-text fusion-text-2\"><p><span style=\"color: #8b0933;\"><strong>Arka Plan ve Ba\u011flam<\/strong><\/span><\/p>\n<p>T\u00fcrkiye 1980\u2019li y\u0131llar\u0131n ortalar\u0131ndan bu yana, \u0130ran Devrimi ile Orta Do\u011fu, Afrika ve G\u00fcneydo\u011fu Asya\u2019daki istikrars\u0131zl\u0131klar nedeniyle \u00e7ok say\u0131da Avrupal\u0131 olmayan s\u0131\u011f\u0131nmac\u0131lara ev sahipli\u011fi yapmaktad\u0131r<a href=\"#_edn4\" name=\"_ednref4\">[4]<\/a>. 1988 ve 1991\u2019de Irakl\u0131 K\u00fcrt m\u00fcltecilerin ak\u0131n\u0131 bu durumu daha da k\u00f6t\u00fcle\u015ftirmi\u015ftir. Bu zaman zarf\u0131nda 1989 yaz\u0131nda Bulgaristan\u2019dan T\u00fcrkler ve daha sonra da Do\u011fu Avrupa\u2019dan m\u00fclteciler T\u00fcrkiye\u2019ye ka\u00e7m\u0131\u015ft\u0131r. Kom\u00fcnist bloktan gelen m\u00fclteciler 1951 S\u00f6zle\u015fmesi\u2019nin sa\u011flad\u0131\u011f\u0131 haklardan yararlan\u0131p, etnik olarak T\u00fcrk olan m\u00fclteciler de koruma ve entegrasyon anlam\u0131nda iyi bir muamele g\u00f6r\u00fcrken, di\u011fer m\u00fclteci gruplar\u0131 T\u00fcrkiye\u2019de koruma mekanizmalar\u0131n\u0131n bulunmay\u0131\u015f\u0131 nedeniyle s\u0131n\u0131r d\u0131\u015f\u0131 edilme gibi durumlarla kar\u015f\u0131la\u015fm\u0131\u015ft\u0131r<a href=\"#_edn5\" name=\"_ednref5\">[5]<\/a>. Belirsizlikleri ortadan kald\u0131rma ve g\u00fcvenlik sa\u011flama amac\u0131 ta\u015f\u0131yan S\u0131\u011f\u0131nma Y\u00f6netmeli\u011fi 1994 y\u0131l\u0131nda haz\u0131rlanm\u0131\u015f<a href=\"#_edn6\" name=\"_ednref6\">[6]<\/a> ve 1999 ile 2006 y\u0131llar\u0131nda belirli de\u011fi\u015fikliklerden ge\u00e7mi\u015ftir. 1994 Y\u00f6netmeli\u011fi\u2019ne ek olarak, 5683 Say\u0131l\u0131 Pasaport Kanunu, 5687 Say\u0131l\u0131 Yabanc\u0131lar\u0131n T\u00fcrkiye\u2019de \u0130kamet ve Seyahatleri Hakk\u0131nda Kanun, 2050 Say\u0131l\u0131 \u0130sk\u00e2n Kanunu ve 5682 Say\u0131l\u0131 Vatanda\u015fl\u0131k Kanunu s\u0131\u011f\u0131nmac\u0131lar\u0131n hak ve y\u00fck\u00fcml\u00fcl\u00fcklerine ili\u015fkin d\u00fczenlemelere yer vermektedir.<\/p>\n<p>Hal b\u00f6yle olsa da 1994 Y\u00f6netmeli\u011fi s\u0131\u011f\u0131nmac\u0131lar\u0131n ve m\u00fcltecilerin haklar\u0131n\u0131 koruma konusunda yetersizdi. Bunun yan\u0131nda bu s\u0131\u011f\u0131nma mekanizmas\u0131 Avrupal\u0131 olmayanlar i\u00e7in uzun vadeli entegrasyona yer vermemekteydi. Pratikte, s\u0131\u011f\u0131nma mekanizmas\u0131 BMMYK M\u00fclteci Stat\u00fcs\u00fc Belirleme Prosed\u00fcr\u00fc ile paralel seyretmekteydi<a href=\"#_edn7\" name=\"_ednref7\">[7]<\/a>. Avrupal\u0131 olmayan s\u0131\u011f\u0131nmac\u0131lar bu prosed\u00fcrde ba\u015fvurular\u0131n\u0131n bir karara var\u0131lmas\u0131n\u0131 beklerken T\u00fcrkiye\u2019de sadece ge\u00e7ici ikamet izinleri alabiliyordu<a href=\"#_edn8\" name=\"_ednref8\">[8]<\/a>. T\u00fcrk h\u00fck\u00fcmeti ve BMMYK aras\u0131ndaki g\u00fc\u00e7l\u00fc i\u015f birli\u011fine ra\u011fmen, A\u0130HM 1994 Y\u00f6netmeli\u011fi\u2019nin yetersizli\u011finden ve yanl\u0131\u015f kullan\u0131m bi\u00e7imlerinden kaynakl\u0131 olarak m\u00fcltecilerin insan haklar\u0131n\u0131 ihlal etti\u011fine h\u00fckmeden T\u00fcrkiye aleyhinde bir\u00e7ok karar vermi\u015ftir. A\u0130HM taraf\u0131ndan verilen kararlar, 1999 ve 2012 y\u0131llar\u0131 aras\u0131nda T\u00fcrkiye \u0130lerleme Raporlar\u0131nda AB taraf\u0131ndan getirilen ele\u015ftiriler ve Suriye\u2019deki \u00e7at\u0131\u015fmalardan kaynaklanan durum, yeni bir kanun haz\u0131rlanmas\u0131n\u0131n ve daha da \u00f6nemlisi T\u00fcrkiye\u2019de yeni bir g\u00f6\u00e7 politikas\u0131 olu\u015fturulmas\u0131n\u0131n ard\u0131ndaki itici g\u00fc\u00e7 olmu\u015ftur.<\/p>\n<p><strong><span style=\"color: #8b0933;\">YUKK\u2019un Genel Hatlar\u0131 ve Uygulanmas\u0131<\/span> <\/strong><\/p>\n<p>Avrupa Birli\u011fi\u2019nden ve A\u0130HM\u2019den gelen bask\u0131lar\u0131n bir sonucu olarak g\u00f6\u00e7 politikas\u0131nda ilk ad\u0131m \u015fimdi G\u00f6\u00e7 \u0130daresi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc olan, S\u0131\u011f\u0131nma ve G\u00f6\u00e7 B\u00fcrosu ve S\u0131n\u0131r Y\u00f6netimi B\u00fcrosu\u2019nun \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131 b\u00fcnyesinde kurulmas\u0131yla at\u0131lm\u0131\u015ft\u0131r. Bu ad\u0131m\u0131 takiben 4 Nisan 2013 tarihli YUKK (6548 Say\u0131l\u0131 Kanun) \u00e7\u0131kar\u0131lm\u0131\u015f ve 11 Nisan 2014\u2019te y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir.<\/p>\n<p>Daha \u00f6nce de belirtilmi\u015f oldu\u011fu gibi YUKK T\u00fcrkiye\u2019de s\u0131\u011f\u0131nmac\u0131 haklar\u0131na ili\u015fkin ilk ulusal kanundur. Yeni kanun T\u00fcrk mevzuat\u0131n\u0131 AB m\u00fcktesebat\u0131na uygun hale getirme amac\u0131yla bir\u00e7ok yeni h\u00fckme yer vermektedir. Kanun yabanc\u0131lar, uluslararas\u0131 koruma ve kurum ba\u015fl\u0131\u011f\u0131 alt\u0131nda yabanc\u0131lara ili\u015fkin konular\u0131 d\u00fczenlemektedir. S\u0131\u011f\u0131nma sistemi idaresi yetkisinin \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131 i\u00e7inde Emniyet Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019nden al\u0131narak G\u00f6\u00e7 \u0130daresi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019ne (G\u0130GM) verilmesi insan haklar\u0131 yakla\u015f\u0131m\u0131n\u0131n benimsenmesini kolayla\u015ft\u0131ran \u00f6nemli bir politika de\u011fi\u015fikli\u011fidir. Bununla birlikte daha \u00f6nce yerel Yabanc\u0131lar, Pasaport, S\u0131n\u0131rlar ve S\u0131\u011f\u0131nma Departmanlar\u0131nda \u00e7al\u0131\u015fmakta olan polis memurlar\u0131n\u0131n buraya yerle\u015ftirilmesi, bu g\u00f6revlilerin s\u0131\u011f\u0131nma sisteminde deneyimli olmas\u0131 nedeniyle s\u0131kl\u0131kla kar\u015f\u0131la\u015f\u0131lan bir uygulamad\u0131r. Bu durumun hak temelli bir yakla\u015f\u0131mdan ziyade g\u00fcvenlik yakla\u015f\u0131m\u0131n\u0131n s\u00fcrd\u00fcr\u00fclmesine yol a\u00e7mas\u0131 muhtemeldir<a href=\"#_edn9\" name=\"_ednref9\">[9]<\/a>. LGBT m\u00fcltecilerinin haklar\u0131 konusunda \u00e7al\u0131\u015fan bir avukat\u0131n beyan\u0131na dayanarak, Denizli\u2019de m\u00fcltecilerle yap\u0131lan m\u00fclakatlar\u0131n halen G\u0130GM i\u00e7in \u00e7al\u0131\u015fmakta olan eski polis g\u00f6revlileri taraf\u0131ndan yap\u0131ld\u0131\u011f\u0131 belirtilmi\u015ftir. Bir di\u011fer sorun da g\u00f6revli say\u0131s\u0131n\u0131n b\u00fcy\u00fck m\u00fclteci n\u00fcfusuyla \u2013 Suriyeliler ile di\u011fer \u00fclke uyruklar\u0131ndan olanlar\u0131 da d\u00e2hil edersek yakla\u015f\u0131k 3 milyon<a href=\"#_edn10\" name=\"_ednref10\">[10]<\/a>&#8211; ilgilenmek i\u00e7in yetersiz olmas\u0131d\u0131r. \u00d6zellikle bu durum m\u00fcltecilerin temel hak ve hizmetlere eri\u015fmesi i\u00e7in gerekli olan kay\u0131t s\u00fcrecini geciktirmektedir.<\/p>\n<p>Avrupal\u0131 olmayan m\u00fcltecilerin mu\u011flak durumuna ili\u015fkin ele\u015ftiriler dikkate al\u0131nd\u0131\u011f\u0131nda<a href=\"#_edn11\" name=\"_ednref11\">[11]<\/a> uluslararas\u0131 koruma yeni s\u0131\u011f\u0131nma mekanizmas\u0131nda b\u00fcy\u00fck bir \u00f6nem arz etmektedir. Bu nedenle, YUKK\u2019un \u00fc\u00e7\u00fcnc\u00fc k\u0131sm\u0131 uluslararas\u0131 korumay\u0131 d\u00fczenlemektedir. D\u00f6rt ilkesel terim kullan\u0131lmaktad\u0131r: m\u00fclteci, \u015fartl\u0131 m\u00fclteci, ikincil koruma ve ge\u00e7ici koruma. \u201cM\u00fclteciler\u201d terimi Avrupal\u0131 m\u00fclteciler i\u00e7in kullan\u0131l\u0131rken, \u201c\u015fartl\u0131 m\u00fclteci\u201d kavram\u0131 co\u011frafi s\u0131n\u0131rl\u0131l\u0131k \u00e7ekincesi nedeniyle Avrupal\u0131 olmayan m\u00fclteciler i\u00e7in kullan\u0131lm\u0131\u015ft\u0131r. Bunun yan\u0131 s\u0131ra 62. maddeye g\u00f6re \u201c\u015eartl\u0131 m\u00fcltecilerin \u00fc\u00e7\u00fcnc\u00fc bir \u00fclkeye yerle\u015ftirilene kadar ge\u00e7ici olarak T\u00fcrkiye\u2019de ikamet etmesine izin verilir.\u201d Dolay\u0131s\u0131yla buradan Avrupal\u0131 olmayan m\u00fcltecilerin yerle\u015ftirme s\u00fcreci tamamland\u0131ktan sonra T\u00fcrkiye\u2019den ayr\u0131lmalar\u0131n\u0131n beklendi\u011fi anla\u015f\u0131labilir<a href=\"#_edn12\" name=\"_ednref12\">[12]<\/a>. Buradan bak\u0131ld\u0131\u011f\u0131nda, T\u00fcrkiye\u2019deki Avrupal\u0131 olmayan m\u00fclteciler i\u00e7in yerel entegrasyon m\u00fcmk\u00fcn de\u011fildir. S\u0131n\u0131r d\u0131\u015f\u0131 etmeme ilkesine ili\u015fkin A\u0130HM kararlar\u0131n\u0131n bir sonucu olarak,<a href=\"#_edn13\" name=\"_ednref13\">[13]<\/a> \u201cm\u00fclteci\u201d ya da \u201c\u015fartl\u0131 m\u00fclteci\u201d say\u0131lamayan ancak \u00f6l\u00fcm cezas\u0131, i\u015fkence ya da gayri insani veya zalimane muamele ya da ceza riskine maruz kalabilece\u011fi ya da silahl\u0131 \u00e7at\u0131\u015fmalar y\u00fcz\u00fcnden genelle\u015ftirilmi\u015f \u015fiddetin bulundu\u011fu \u00fclkesine ya da daha \u00f6nce ikamet etti\u011fi \u00fclkeye g\u00f6nderilmesi m\u00fcmk\u00fcn olmayan bireyler i\u00e7in ise \u201cikincil koruma\u201d kavram\u0131 sa\u011flanm\u0131\u015ft\u0131r (63. madde).<\/p>\n<p>Hem \u201c\u015fartl\u0131 m\u00fclteciler\u201d hem de \u201cikincil koruma\u201d i\u00e7in koruma ba\u015fvurusunda bulunmaya y\u00f6nelik prosed\u00fcr\u00fcn eri\u015filebilirli\u011fi hayati \u00f6nemdedir. Bu noktada YUKK ba\u015fvuru prosed\u00fcr\u00fcn\u00fc detayl\u0131 bir bi\u00e7imde d\u00fczenlemektedir (madde 65 &#8211; 72). Ancak m\u00fclteci haklar\u0131 konusunda \u00e7al\u0131\u015fmakta olan avukatlarla yapm\u0131\u015f oldu\u011fum gayri resmi g\u00f6r\u00fc\u015fmelere dayanarak, g\u00f6revlilerin karar verecek bilgiye sahip olmamas\u0131 ve\\ya ge\u00e7mi\u015fte verilen keyfi kararlar nedeniyle kayda de\u011fer yanl\u0131\u015f uygulamalar oldu\u011funu s\u00f6yleyebilirim. Reddedilmi\u015f olan ba\u015fvuru formlar\u0131, ba\u015fvurucunun bir avukatla irtibat kurmas\u0131na izin verilmiyor olu\u015fu ve terc\u00fcme hizmetinin bulunmay\u0131\u015f\u0131 \u00f6zellikle havaalanlar\u0131 gibi ge\u00e7i\u015f alanlar\u0131nda kar\u015f\u0131la\u015f\u0131lan en yayg\u0131n ihmaller aras\u0131ndad\u0131r. Di\u011fer yandan A\u0130HM\u2019in T\u00fcrkiye\u2019nin keyfi kararlar\u0131 ve s\u0131n\u0131r d\u0131\u015f\u0131 edilme g\u00f6zalt\u0131nda tutulmaya ili\u015fkin mevzuat\u0131n\u0131n bulunmay\u0131\u015f\u0131na ili\u015fkin i\u00e7tihad\u0131 nedeniyle, YUKK bu uygulamalara ili\u015fkin prosed\u00fcre a\u00e7\u0131kl\u0131k getirmi\u015ftir. Bu konudaki en \u00f6nemli ve etkili d\u00fczenlemeler 54\/1(i) ve 80\/1(e) maddelerinde yer almaktad\u0131r. Bu maddeler uzakla\u015ft\u0131rma karar\u0131na tabi olan ki\u015filerin ilgili mahkemeler nihai kararlar\u0131n\u0131 verene kadar T\u00fcrkiye\u2019de kalabilmesini sa\u011flamaktad\u0131r. YUKK\u2019tan \u00f6nce resen s\u0131n\u0131r d\u0131\u015f\u0131n\u0131n ask\u0131ya al\u0131nmas\u0131 s\u00f6z konusu de\u011fildi. Bu nedenle mahkemeler nihai kararlar\u0131n\u0131 vermeden \u00f6nce s\u0131n\u0131r d\u0131\u015f\u0131 yap\u0131labiliyordu. Bu yanl\u0131\u015f uygulaman\u0131n bir sonucu olarak, s\u0131n\u0131r d\u0131\u015f\u0131n\u0131n acil ve hayati durumlarda yap\u0131lmas\u0131n\u0131 engellemek i\u00e7in avukatlar s\u0131kl\u0131kla A\u0130HM i\u00e7tihad\u0131n\u0131n 39. maddesi gere\u011fi ge\u00e7ici tedbir al\u0131nmas\u0131 i\u00e7in ba\u015fvuruda bulunmak zorundayd\u0131lar<a href=\"#_edn14\" name=\"_ednref14\">[14]<\/a>.<\/p>\n<p>YUKK taraf\u0131ndan tan\u0131nm\u0131\u015f olan son kategori \u201cge\u00e7ici koruma\u201dd\u0131r ve bu stat\u00fc sadece Suriye\u2019den gelmekte olan m\u00fcltecilere verilmektedir<a href=\"#_edn15\" name=\"_ednref15\">[15]<\/a>. Suriye\u2019deki \u00e7at\u0131\u015fmalar YUKK\u2019un \u00e7\u0131kar\u0131lmas\u0131ndan \u00f6nce ba\u015flam\u0131\u015f oldu\u011fu i\u00e7in, Afet ve Acil Durum Y\u00f6netimi Ba\u015fkanl\u0131\u011f\u0131 (AFAD) 2011 y\u0131l\u0131nda T\u00fcrkiye\u2019deki m\u00fclteci krizinin y\u00f6netilmesinde g\u00f6revli ana kurum olarak belirlenmi\u015fti. Suriyeli m\u00fcltecilere y\u00f6nelik yakla\u015f\u0131m ilk ba\u015flarda onlar\u0131 \u201cmisafir\u201d olarak tan\u0131mlamaya dayanmaktayd\u0131. K\u0131sa bir s\u00fcre sonra 2012 y\u0131l\u0131n\u0131n Mart ay\u0131nda, \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131 taraf\u0131ndan yay\u0131nlanm\u0131\u015f olan \u201cgizli y\u00f6netmelik\u201dle Suriye\u2019den gelen m\u00fcltecilerin stat\u00fcs\u00fc \u201cge\u00e7ici koruma\u201d olarak belirlenmi\u015ftir. Bu arada s\u00f6z konusu gizlilik durumu sivil toplum taraf\u0131ndan ele\u015ftirilmi\u015ftir<a href=\"#_edn16\" name=\"_ednref16\">[16]<\/a>. YUKK y\u00fcr\u00fcrl\u00fc\u011fe girdikten sonra G\u00f6\u00e7 \u0130daresi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc himayesinde uygulanmak zorunda olmu\u015ftur. Ancak, m\u00fclteci kamplar\u0131n\u0131n idaresi AFAD\u2019\u0131n yetkisinde kalm\u0131\u015ft\u0131r. Buna kar\u015f\u0131n, 2014\u2019\u00fcn ikinci yar\u0131s\u0131ndan itibaren kitlesel bir bi\u00e7imde T\u00fcrkiye\u2019ye gelmelerine ra\u011fmen, Irakl\u0131 s\u0131\u011f\u0131nmac\u0131lar ge\u00e7ici korumaya tabi de\u011fildirler. Irakl\u0131 s\u0131\u011f\u0131nmac\u0131lar i\u00e7in h\u00e2lihaz\u0131rda iki se\u00e7enek bulunmaktad\u0131r: uluslararas\u0131 koruma i\u00e7in ba\u015fvurmak ya da \u201cinsani gerek\u00e7elere dayanarak ikamet izni alma\u201d talebinde bulunmak. Stat\u00fclerine ili\u015fkin bu belirsizlik sa\u011fl\u0131k gibi zaruri ihtiya\u00e7lara y\u00f6nelik hizmetlere eri\u015febilmelerine engel olmaktad\u0131r<a href=\"#_edn17\" name=\"_ednref17\">[17]<\/a>. \u015ea\u015f\u0131rt\u0131c\u0131 bir bi\u00e7imde,&nbsp; \u201cinsani gerek\u00e7elere dayanarak ikamet izni\u201d alan Irakl\u0131 s\u0131\u011f\u0131nmac\u0131lar\u0131n say\u0131s\u0131na ili\u015fkin istatistikleri g\u00f6steren eri\u015filebilir bir veri bulunmamaktad\u0131r. Bu noktada, olduk\u00e7a benzer durumlarda neden farkl\u0131 koruma mekanizmalar\u0131na ba\u015fvurulmakta oldu\u011fu sorusu sormaya de\u011ferdir.<\/p>\n<p>Yapm\u0131\u015f oldu\u011fum ara\u015ft\u0131rmalar, yukar\u0131da bahsedilen bu kategorilere g\u00f6re sahada farkl\u0131 uygulama ve alg\u0131lar bulundu\u011funu g\u00f6stermektedir. Bu durum sadece hukuksal \u00e7er\u00e7eveden de\u011fil ayn\u0131 zamanda T\u00fcrk h\u00fck\u00fcmetinin izledi\u011fi politikalardan da kaynaklanmaktad\u0131r. Medyadaki g\u00f6r\u00fcn\u00fcrl\u00fck, n\u00fcfuslar\u0131n\u0131n \u00e7oklu\u011fu ve h\u00fck\u00fcmetin onlar\u0131 iyi kar\u015f\u0131lamas\u0131 gibi nedenlerle Suriyeli m\u00fclteciler kamuoyunun tabiri caizse g\u00f6z\u00fc \u00f6n\u00fcndedir. Ancak Suriyeli olmayan m\u00fclteciler \u00e7ok uzun bir s\u00fcredir g\u00f6rmezden gelinmektedir. Bunun yan\u0131 s\u0131ra, Irak ve Afgan m\u00fcltecilerle ger\u00e7ekle\u015ftirilen gayr\u0131 resmi g\u00f6r\u00fc\u015fmeler temelinde, bu durum farkl\u0131 m\u00fclteci gruplar\u0131 aras\u0131nda \u201cbir hiyerar\u015fi olu\u015ftu\u011fu\u201d \u015feklinde alg\u0131lanmaktad\u0131r.<\/p>\n<p><strong><span style=\"color: #8b0933;\">Hukuki Yanl\u0131\u015f Uygulaman\u0131n \u00d6tesindeki Karma\u015f\u0131kl\u0131klar ve \u00d6neriler<\/span> <\/strong><\/p>\n<p>Her \u015feyden \u00f6nce co\u011frafi s\u0131n\u0131rlaman\u0131n korunmas\u0131, geldikleri \u00fclkeye ba\u011fl\u0131 bir m\u00fcltecilik stat\u00fcs\u00fc ortaya \u00e7\u0131kard\u0131\u011f\u0131ndan mu\u011flak bir durum yaratmaktad\u0131r. Bu ikilik \u00e7\u00f6z\u00fclmeden m\u00fclteci haklar\u0131na tam olarak sayg\u0131 duyulmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Bu nedenle, co\u011frafi s\u0131n\u0131rl\u0131l\u0131k kesinlikle kald\u0131r\u0131lmal\u0131d\u0131r.<\/p>\n<p>Kanunlar\u0131n yanl\u0131\u015f uygulanmas\u0131ndan kaynaklanan sorunlar\u0131n yan\u0131 s\u0131ra g\u00f6\u00e7 politikalar\u0131n\u0131n yetersizli\u011fi nedeniyle ortaya \u00e7\u0131kan sorunlar s\u00f6z konusudur. Dil, onca y\u0131ldan sonra e\u011fitim, sa\u011fl\u0131k, hukuki destek ve emek piyasas\u0131na eri\u015fim anlam\u0131nda m\u00fcltecilerin g\u00fcndelik hayatlar\u0131n\u0131 etkileyen \u00f6nemli bir sorun olarak kalmaktad\u0131r<a href=\"#_edn18\" name=\"_ednref18\">[18]<\/a>. M\u00fcltecilere y\u00f6nelik T\u00fcrk\u00e7e dil kurslar\u0131n\u0131n kapasitelerini art\u0131rman\u0131n yan\u0131nda T\u00fcrk personellere de Arap\u00e7a ve Fars\u00e7a gibi yabanc\u0131 dillerin \u00f6\u011fretilmesi de\u011ferlendirilmelidir. Entegrasyon; kar\u015f\u0131l\u0131kl\u0131l\u0131k gerektiren bir s\u00fcre\u00e7 oldu\u011fu i\u00e7in yerel halk\u0131n e\u011fitimi her iki taraf i\u00e7in de s\u00fcrecin daha rahat ilerlemesine yard\u0131mc\u0131 olacakt\u0131r.<\/p>\n<p>Bir di\u011fer kritik nokta da T\u00fcrkiye\u2019deki g\u00f6\u00e7 politikalar\u0131na toplumsal cinsiyet perspektifinin d\u00e2hil edilmesi gereklili\u011fidir. Bar\u0131nma, fiziksel g\u00fcvenlik, sa\u011fl\u0131k, psikolojik m\u00fcdahale, g\u0131da g\u00fcvenli\u011fi, e\u011fitim, gelir ve hukuki dan\u0131\u015fmanl\u0131k hizmeti gibi ihtiya\u00e7lar kad\u0131n m\u00fcltecilerin k\u0131r\u0131lgan konumlar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in elzemdir. Bunun yan\u0131nda, kentli kad\u0131n m\u00fcltecilere eri\u015fimin zorlu\u011fu onlara y\u00f6nelik proje ve politikalar\u0131n daha fazla \u00f6nem ta\u015f\u0131d\u0131\u011f\u0131 anlam\u0131na gelmektedir<a href=\"#_edn19\" name=\"_ednref19\">[19]<\/a>.<\/p>\n<p>Yapm\u0131\u015f oldu\u011fum g\u00f6zlemler, mali sorunlar gibi ihtiya\u00e7lar\u0131na cevap alabilmek i\u00e7in ilk \u00f6nce belediyeleri ziyaret eden m\u00fcltecilerin temel hizmetler ve benzeri ihtiya\u00e7lara eri\u015fmekte ba\u015far\u0131s\u0131z oldu\u011funu g\u00f6stermektedir. Bu noktada yerel makamlar\u0131n, \u00f6zellikle ihtiya\u00e7 sahibi m\u00fcltecilere eri\u015fmede \u00f6nemli bir rol\u00fc vard\u0131r. Bu bak\u0131\u015f a\u00e7\u0131s\u0131ndan ele al\u0131nd\u0131\u011f\u0131nda, hizmet sa\u011flamay\u0131 daha organize ve sistematik hale getirmek amac\u0131yla, belediyeler g\u00f6\u00e7 dan\u0131\u015fmanlar\u0131n\u0131 da bar\u0131nd\u0131ran g\u00f6\u00e7 b\u00f6l\u00fcmleri kurmal\u0131d\u0131rlar. Bunun sa\u011flanmas\u0131 \u201chay\u0131rsever\u201d politikalar yerine hak temelli bir yakla\u015f\u0131m\u0131n benimsenmesine yard\u0131mc\u0131 olabilir.<\/p>\n<p>Ayn\u0131 zamanda g\u00f6\u00e7 politikalar\u0131n\u0131 planlamak ve icra etmek i\u00e7in YUKK\u2019un d\u00fczenlenmi\u015f olmas\u0131 gibi, G\u0130GM b\u00fcnyesinde bir G\u00f6\u00e7 Politikalar\u0131 Kurulu\u2019nun olu\u015fturulmas\u0131 tamamlanmal\u0131d\u0131r. G\u00f6\u00e7 politikalar\u0131nda bir insan haklar\u0131 yakla\u015f\u0131m\u0131n benimsenmesi ve hayata ge\u00e7irilmesi hesaba kat\u0131lmal\u0131d\u0131r.<\/p>\n<p>YUKK T\u00fcrkiye\u2019nin g\u00f6\u00e7 politikas\u0131nda bir de\u011fi\u015fime do\u011fru at\u0131lm\u0131\u015f \u00f6nemli bir ad\u0131md\u0131r. Ancak, bu temelde ger\u00e7ek bir de\u011fi\u015fim sa\u011flamak i\u00e7in kanun tek ba\u015f\u0131na yeterli de\u011fildir.
